1: Object

These terms and conditions govern the sales by PACAP of fashion clothing and accessories.

2: Price

The prices of our products are indicated in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise specified and excluding processing and shipping costs. In case of order to a country other than metropolitan France you are the importer of the product (s) concerned. Customs duties, local taxes or import duties or state taxes may be payable outside France. These rights and amounts do not fall under the jurisdiction of CAPAP. They will be your responsibility and your entire responsibility, both in terms of the declarations (invoice attached to the shipment) and payments to the competent authorities and bodies of your country.

Article 4: Validating your order

5: Payment

Validating your order means that you have to pay the specified price.
The payment of your purchases is made according to your choice by credit card thanks to the secure system, by check or by PayPal, see bank transfer.

The debit of the card is only done at the time of shipment of the order. In the case of split deliveries, only shipped products are debited.

Article 6: Tracing

Article 7: Availability

Our products are proposed as long as they are visible on the PACAP site and within the limit of available stocks. For non-stocked products, our offers are valid subject to availability created by our artisans.

In case of unavailability of product after placing your order, we will inform you by email or by telephone. Your order will be automatically canceled and no bank debit and we charge no charges or file charges.

Article 8: Delivery

The products are delivered by the Post Office to the delivery address you indicated to us during the order process, within the time specified on the validation page of the order.
In case of delayed shipment, an email will be sent to inform you of a possible consequence on the delivery time that has been indicated to you.

In accordance with the legal provisions, in case of delay in delivery, you benefit from the possibility of cancelling the order under the conditions and modalities defined in article L 138-2 of the Consumer Code. If between time you receive the product we will proceed to its refund and to the shipping costs in the conditions of article L 138-3 of the Consumer Code.

Article 9: Warranty

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for in articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, you can return it, exchange or refund according to your choice.

Article 10: Liability

The liability of the PACAP society cannot be incurred in the event of non-compliance with the legislation of the country in which the product is delivered. 15: Reimbursement

However, if the order has already been shipped, the refund can only be counted from the date of receipt of the returned product with its original packaging. Shipping charges will be deducted based on the cost charged by the carrier.

Sorted products are not retaken or refunded.

1: INTRODUCTION


The PRO SPACE is exclusively reserved for professionals who wish to distribute the products of the PACAP brand.
You must provide an intra-Community VAT number when you register, or if necessary your SIRET number (self-contractors), otherwise your order cannot be processed.

You can log in directly to your 24-hour account with your username and password.
You can then discover our different collections and rates to make your order.

3: HOW TO PASSED YOUR


3.1: 2 ways

If you are already a customer, your usual conditions of payment will be applied.

In all cases, the contract of sale is deemed to have been concluded only at the time of the full receipt of the reservation order by PACAP.
PACAP reserves the right not to cash a payment and therefore not to confirm an order for any reason, in particular a problem of competition, a problem of supply of products, a problem concerning the order received (ex: Unreadable document), an abnormal command, or a predictable problem with the delivery to be performed (e.g., out of delivery area).
In the event that one of the items ordered is not available in our inventory (following an inventory spread for example), we undertake to contact you by e-mail or by telephone within 5 days from the date of your order in order to inform you, and to reimburse you within 30 days the products not available for delivery, if they were cashed during the order.

5: DELIVERY AND DELIVERY COSTS


Your order will be shipped from our warehouse based in Aubagne, South of France for France and the rest of the world. We choose for each shipment the most competent and economical carrier (La Poste, UPS, DHL, TNT, DPD)
Delivery costs are calculated in the right of reservation according to the actual weight of the packages.

6: SATISFAIT OR REIMBURSE. LAWRETRACT


You get 14 days to return products that don't satisfy you. This is a short time from receipt of the product.
You can then return these products, along with your invoice, without any reason to give, or any penalties to be paid. On the other hand, the direct costs of sending and returning the goods are at your expense.
The return of the products can only be accepted for products in their original state, namely with their packaging and without annotation on the labels. The shipping costs are borne by the customer.
In case of proven non-compliance, PACAP will replace the product.
